SERVICES OFFERED

Through the Site, we provide the Editing Service, the Writing Service, the Homework Service, and the Translations Service (which are collectively referred to in these Terms as the "Services"). Through the Services, we facilitate the exchange of information between Client users of the Web Site (the "Clients") and tutors (the "Tutors") who have agreed to provide certain services to Studyhood relating to a wide range of academic subjects.  By agreeing to the Terms, you are deemed to have represented and warranted to Studyhood that you have attained the age of majority in the jurisdiction in which you reside. You also understand and agree that the services may include certain communications from Studyhood, such as service announcements, administrative messages and news, and that these communications are considered part of Studyhood membership and you will not be able to opt out of receiving them, unless otherwise stated by you.

TRADEMARKS, COPYRIGHTS AND RESTRICTIONS

All content on this Web Site, including, but not limited to text, images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, service marks, and/or other intellectual property rights (which are governed by Cyprus and worldwide copyright laws and treaty provisions, privacy and publicity laws, and communication regulations and statutes), and are owned and controlled by Studyhood or its affiliates, or by third party content providers, merchants, sponsors and licensors (collectively "Providers") that have licensed their content or the right to market their products and/or services to Studyhood, Content on this Web Site or any web site owned, operated, licensed or controlled by the Providers is solely for your personal, non-commercial use. You may print a copy of the content and/or information contained herein for your personal, non-commercial use only, but you may not copy, reproduce, republish, upload, post, transmit, distribute, and/or exploit the content or information in any way (including by e-mail or other electronic means) for commercial use without the prior written consent of Studyhood or the Providers. Without the prior written consent of Studyhood or the Providers, your modification of the content, use of the content on any other web site or networked computer environment, or use of the content for any purpose other than personal, non-commercial use, violates the rights of the owners of the studyhood.com and/or the Provider copyrights, trademarks or service marks and other proprietary rights, and is prohibited. As a condition to your use of this Web Site, you warrant to Studyhood that you will not use our Web Site for any purpose that is unlawful or prohibited by these Terms, including without limitation the posting or transmitting any threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material. If you violate any of these Terms, your permission to use our Web Site immediately terminates without the necessity of any notice. Studyhood retains the right to deny access to anyone at its discretion for any reason, including for violation of these Terms. You may not use on your web site any trademarks, service marks or copyrighted materials appearing on this Web Site, including but not limited to any logos or characters, without the express written consent of the owner of the mark or copyright. You may not frame or otherwise incorporate into another web site any of the content or other materials on this Web Site without prior written consent of Studyhood

CONTENT OF SUBMITTED OR/AND CREATED MATERIAL

This Site contains materials from a variety of sources including materials submitted by Clients and Tutors.  Site contents may be protected by copyright and moral rights as original literary, dramatic, musical or artistic works, including compilations and computer programs.
(a) Documents Not to Infringe Copyright. Clients are advised that plagiarism and breach of copyright are serious offences. Studyhood assumes no responsibility or liability for the infringement of third party copyright in the content of client documents. Whilst recognizing the right to free speech, Studyhood reserves the right to refuse to edit/write/translate or create any document that advocates or incites violence, hatred or discrimination in contravention of national and international laws.
(b)  Questions Not to Infringe Copyright. In using the Homework Service, Clients will post questions on academic subjects, following system prompts provided.  In submitting a question to the Homework Service, Clients are deemed to have warranted to Studyhood that the question does not infringe copyright (for example, by reproducing a substantial part of a work, such as an assignment, journal article or textbook), moral rights or any other right of any third party. Studyhood reserves the right to edit questions, as it deems necessary to ensure that copyright and moral rights are not infringed.
(c)  Prohibited Content. Studyhood reserves the right to revise or delete any question from the Services for any reason whatsoever. Clients are deemed to have warranted to Studyhood that questions shall not include material that is false, defamatory, abusive, vulgar, hateful, harassing, obscene, pornographic, profane, threatening, or invasive of any person's privacy or intellectual property rights, violates any law or is otherwise inappropriate for the Services. Advertisements, chain letters and other forms of solicitation shall not be included.  Tutors and others who feel that questions are objectionable are encouraged to contact Studyhood by email.  Studyhood may, within a reasonable time frame, and in its sole discretion and at a time of its choosing, determine that a question is inappropriate for the Services and revise or delete it.  Studyhood reserves the right to reveal information about Clients, as Studyhood deems advisable, in connection with complaints, legal actions, or bona fide allegations of plagiarism related to use of the Services.
(d)  Studyhood assures that all work will not be resold, distributed or placed on any website or essaybank after its completion, unless the work is not paid by the customer.
(e) For the writing and homework services: Studyhood, its employees, associates, independent contractors and its agents do not support or ignore plagiarism, and reserve the right to refuse supply of our services to those that we suspect of such behaviour. The Client accepts that Studyhood provides independent personalised research services in order to help students learn and advance educational standards.
(f) Studyhood agrees that if the work does not meet the initial agreement, between Studyhood Tutor and Client, for the tasks to be done, the Client has the right to free amendments so the help received meets the original specifications. The Client acknowledges that amendments are available only if they contact Studyhood within 7 days of the due delivery date, and that amendments submitted after this time may not be undertaken without an additional charge at cost price or in exceptional circumstances, at all.
(g) A guaranee of 500 Euros is applied when a Client detects any plagiarism in the work it has been supplied by Studyhood - the definition of plagiarism is taken to constitute any act where work has copied, paraphrased, edited, summarised or rearranged any information from any website, book, journal, essay, past piece of work or any other source, either in whole or in part, without giving the corresponding references. The guarantee will not apply in conditions where Studyhood detects plagiarism before the work is supplied to the Client, in which event re-tutoring or a fully money back refund will be provided, at the Client's discretion.
(h) Studyhood provides that any Client that detects plagiarism as defined above will be awarded 500 Euros. Additionally, they will receive their money back in full. The Client agrees that Studyhood acts as an agent for their Tutors and that the 500 Euros will be provided to Studyhood directly by the Tutor responsible. Studyhood will then transfer the 500 Euros in not less than 7 days via bank transfer directly in to the Client's account.
(i) Studyhood agrees that if any Tutor responsible for any plagiarism offence fails to award the 500 Euros compensation, that they will assist the Client by providing a copy of the Tutor's contract and their name and address for the Client to bring any remedial action directly.
(j) The writer/homework solver/tutor and any other associate who takes on a job (writing, homework, etc.) agrees to deliver it within the agreed framework, including deadlines, earnings and other details. If a writer/homework solver/tutor or any other associate fails to follow the agreed framework, Studyhood has the right to terminate the agreement, and thus the agreement is cancelled. In such as case, the writer/homework solver/tutor or any other associate agrees to pay Studyhood Ltd. the amount that corresponds to the cost of the job that he/she failed to complete according to the agreed framework.
(k) The Customer agrees that once an order is paid, and Studyhood begins work, then the order may not be cancelled or refunded.
(l) Studyhood associates/independent contractors agree that the work they complete for Studyhood will not be resold, distributed or placed on any website or essaybank after its completion.

REFUSAL OR DENIAL OF SERVICE

Studyhood reserves the right to deny or refuse service to any client or prospective client for any reason and without explanation.

SERVICE QUALITY AND STANDARDS

All documents are edited, written, created or translated to a high and exacting standard. However, Studyhood provides no guarantee that the Client's work will be error free. Furthermore, Studyhood is not responsible for service delays resulting from unforeseen circumstances such as technical problems, including server issues that are beyond our control.

SERVICE GUARANTEE AND REFUND POLICY

Studyhood provides Clients with the best possible quality of service. Should a Client be dissatisfied with the editing, writing, homework or translating service, Studyhood will refund the Client's payment. However, any such refund is conditional on the Client demonstrating conclusively how Studyhood failed to meet its service obligations.

ACCURACY OF CLIENT INFORMATION AND REFUND POLICY

The Client must provide true and accurate information with respect to their name, address, e-mail address, phone number, service requirements and all payment details. Failure to provide correct and accurate information can result in a refusal to provide service. The client assumes all responsibility for any problems, errors, issues, as well as legal liability, resulting from such false information. All information submitted by the client is confidential. Should a Client provide wrong information on the service requirements (e.g. 2000 instead of 3000 words), Studyhood reserves the right to cancel the order and refund the Client's payment. Should a Client ask the cancle of and order that is moved to the processing stage by one of our Tutors, Studyhood reserves the right to make a partial refund according to the cost of the work done by out Tutor.

PAYMENTS

Payments: Payments to Studyhood relating to your use of the Services shall be by credit card system provided by third party service providers selected by Studyhood  Currently, such payments shall be made through the services of PayPal. For further information, see their Internet web site at www.PayPal.com. Currently, through these third party service providers, the following credit cards may be used to pay for Studyhood services:  VISA, MASTERCARD, VISA DELTA, VISA PURCHASING AND LASER. Prior to using the Services, you should review the privacy policy of whichever provider you are using. Information may be obtained from the providers’ respective websites as noted above. An alternative option is to make a payment via bank transfer.

THIRD PARTY RIGHTS

These Terms are for the benefit of Studyhood and its Providers, its and their officers, directors, employees, affiliates, agents, licensors, and suppliers. Each of these individuals or entities shall have the right to assert and enforce these Terms directly against you on its or their own behalf.

JURISDICTION

The Services are offered via the Internet and the Clients and Tutors are located throughout Cyprus, the United Kingdom and in other jurisdictions world-wide. This Web Site is controlled and operated by Studyhood from its offices within Pafos, Cyprus. Studyhood makes no representation that content in its Web Site is appropriate or available for use in other locations. Those who choose to access this Web Site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. You may not use or export the materials in this Web Site in violation of Cyprus export laws and regulations. These Terms shall be governed by, construed and enforced in accordance with the laws of Cyprus, as they are applied to agreements entered into and to be performed entirely within such Country. Any action you, any third party or Studyhood brings to enforce these Terms, or in connection with any matters related to this Web Site, shall be brought only in Cyprus courts and you expressly consent to the jurisdiction of said courts. If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed sever able from these Terms and shall not affect the validity and enforceability of any remaining provisions.

MODIFICATIONS OF TERMS OF SERVICE AND SERVICE

Studyhood reserves the right to modify the Terms of Service at any time. Studyhood also reserves the right to modify or discontinue, temporarily or permanently, its services with or without notice to Client or/and Tutor. You agree that Studyhood shall not be liable to you or any third-party for any modification or discontinuance of its services.

TERMINATION

The Terms of Service are effective until terminated by Studyhood, at any time without notice. Studyhood may also discontinue or terminate operation of its Web site, services or trading name without notice at any time and for any reason .

ENTIRE AGREEMENT

The provisions and conditions of these Terms, and each obligation referenced herein, represent the entire Agreement between Studyhood, its affiliated or related entities, and you, and supersede any prior agreements or understandings not incorporated herein. In the event that any inconsistencies exist between these Terms and any future published terms of use or understanding, the last published Terms or terms of use or understanding shall prevail.
